The proposed neonicitinoids (neonic) regulations have been reviewed by the Office of Administrative Law (OAL) and were completed April 12, 2023. The regulation, which will become effective on January 1, 2024, states that the mitigations do not apply under the following scenarios:
- An application made to address a local emergency pursuant to Government Code section 8630 or a local emergency declared by the U.S. Department of Agriculture or the California Department of Food and Agriculture. The operator of the property shall obtain the written recommendation from a licensed agricultural pest control adviser and retain the written recommendation for at least two years after the application occurs;
- An application to control a quarantine pest declared by the U.S. Department of Agriculture or the California Department of Food and Agriculture if the operator of the property obtains written recommendation from a licensed agricultural pest control adviser. The operator of the property shall retain the written recommendation for at least two years after the application occurs.
If the use is justified by a PCA, safe applications can be made during environmental emergencies declared by CDFA in order to remove harmful pests such as ACP for citrus applications. Prior to the adoption of regulations, CCM provided technical recommendations and comments to the proposed version of regulations during the public comment phases based on its need to fend off ACP and HLB.
